Today I am again writing a real painful story that recently our team had to face due to the recklessness and gross negligence of the campus administration. I don’t know what to call it i.e. a story or a traumatic incident, I am confused myself. I know by writing and sharing these things, the distressing incident cannot bring back what we have lost, but it is for the memory. I have no intention of writing bitterly about the campus administration based on facts. But my intention is certainly to raise questions about the qualifications and competence of the so-called scholars or examiner concerned. As a result, sometimes I get distracted by the system here and am forced to write.
A few days ago, we got to see a notice of moot court of Bharatraj Upreti Foundation in our campus which was already known to the campus administration and moot court society, but the general students were informed late. The notice was issued on May 6 and the campus gave the deadline for submission till May 13. Personally, I was very excited about this moot court and started building a team. Finally, I, my classmate Shehnaz Khatun and junior Nabina Ghimire formed a team and started working on the memorial.
Before this I was about to participate in Jessup Moot Court 2022 but due to my personal reasons, I had to drop out midway. After that, due to various reasons I could not attend the moot court and this time I got a chance, and I thought I should not miss it. My classmate Shehnaz participated in this BRU moot court last year too and Nabina also participated in Jessup moot court last year. That’s why both had more knowledge of moot court than me. Eventually, we started working towards preparing the memorial. We had a good time together while working on the memorial. The biggest thing is team coordination, and it was very good in our unit. It took 5 days to prepare the memorial and 2 days to edit it as counting down the days. We wanted to make our memorial far better that is why, we took 2 days for editing. Finally, after seeing everything in the memorial, we handed over our memorial to the administration on 13th May.
Although everyone likes the work what they have done, we believed that our memorial turned out be much better because we spent half of every day i.e. almost 4/5 hours doing research in campus. We were confident that we would be selected because two of us had previous experience and we had worked hard as well. On 15th May at around 5:00 pm the notice of selection committee came on the official website of the campus and with excitement we saw the notice but shortly we got disappointed because we could not be selected. After that, we decided to visit the campus with the aim of knowing our shortcomings, weaknesses, mistakes or errors in the submitted memorial in order that we can improve them as detected by the checkers in the upcoming days. My classmate Shehnaz sent a message to the campus chief the same day that we would go to the office the next day to get feedback. And the next day we went to the office and told our complaint to the campus chief and requested to call the concerned lecturer(s)/checker(s) to show our shortcomings or weaknesses in the memorial. The campus chief said that the decision would be taken only after consulting the lecturer(s) concerned first. He further said that who inspected our memorial should be kept a secret. We were surprised to hear this because we did not ask for our board exam copy. It was just a matter of pointing out errors and giving feedback and suggestions.
In other campuses/colleges the Moot Court Committee/board/department is coordinated by a faculty member or Associate Professor or Lecturer in Law and the task of examining memorials or coaching or instructing is done by the said committee/board/department. In contrast, our campus has a Moot Court society consisting only of students. In a society/nation like ours where merit and meritocracy have no meaning and everything is driven by politics, nepotism, favouritism etc. a learned person or a law student or a sensible person can easily understand what it means or what effect it can have. Anyway, the Campus Chief did not even show us our memorial at first and asked us to go to class and said that he would talk to us after some time. We did not agree to go to the class because transparency was must in that matter as there was nothing important to hide. After a while Chief sir went out and consulted the lecturer(s) and came inside and gave us our memorial on a table. We were really surprised by his action because we wanted a concerned lecturers/checkers to point out our shortcomings and mistakes and make us aware of them. He just said, ” Have a look”. How can we know our own weaknesses and mistakes? We requested a lot to call the concerned lecture(s)/checker(s) inside, but he did not listen to us and finally we thanked him and left the office. Indeed, we were there to see our flaws or errors pointed out or indicated at the memorial, but it didn’t happen. We were very disappointed with the modus operandi of the campus administration and the Moot Court Society
This is not a new thing for us because everything can happen here, and everything can be made possible here. Frankly speaking, if indeed Commission for the Investigation of Abuse of Authority investigates our campus/university with full of honesty & transparency, heaps of recklessness and negligence may be uncovered. Let’s not discuss other topics, as a student, I prefer to write only about the education system. We want to grow up but for some reason some things play a major villain role for us, and we don’t get a chance to climb up. By this way, students can face a lot of trauma and depression. This kind of gross negligence by the campus has left me and my teammates traumatized. The campus neither wants to show the memorial examiner nor to point out the shortcomings of our memorial. They want to close the matter saying that it is a matter of confidentiality. What confidentiality? What type of confidentiality is this? I think this matter shouldn’t remain confidential as it is the matter of knowing the weakness & mistakes so that it can be corrected in upcoming days. Well, we did not find any valid reason behind not selecting for BRU moot court. The campus didn’t give us any legitimate reason. They shut it down saying it should be kept confidential. Two days later, from a secondary source, we heard that the reason for not getting selected for BRU was poor English language used in. Hearing such a disgusting answer from the third person, we laughed for a moment and got angry at the same time.
How can we have problems in English? Here, I don’t mean that we are 100% perfect in English, but our sentence construction or grammar used in the formation of sentences is not weak in our memorial. This is my legitimate claim, and it can be verified by any English language expert. Talking about myself, I have been writing English articles continuously for over 6 years and have been successful in publishing in many reputed online and print newspaper and I have also published a book last year. Another friend of mine, Shehnaz Khaatun, has a very good command in English. Moreover, she is a member of USYC 2024 and finally, Nabina Ghimire is a good listener having a good command in English and falls in the A category of her batch. We all have our own characteristics and qualities in English, then how can our sentence construction and English grammar be poor in memorial. If the campus administration is willing, then we will again dare to see our memorial with a good moot court instructor/expert having good command over English. Then everyone will know the bitter fact and truth. If the campus administration has even a little daring, then make our memorial public so that every student studying in the city campus can see it.
Sometimes we feel very sorry for the institution whose name is Lumbini “Buddhist” University. If even in a Buddhist University, such gross negligence is taken with the students or the future of the students, then what can be expected from other institutions. Here, many faculty members in the campus lack norms, values, and professional ethics. If they keep honouring the person rather than fact and truth in the forthcoming days, then they are not a rational person at any cost. Also, the campus/university will have to pay a heavy price for this in future i.e. its reputation, product etc. By the way, we law students are facing injustice, and it is a shame for us as well. We have no choice but to accept the decision of the campus administration. I guess that in some parts of life to come, our faculty members will really realize their gross negligence in various matters and prejudice applied to some students and if they don’t or will not realize they don’t belong to academic career people.
